Court of appeal Judge Kantai Ole Sankai has been linked to the planning and murder of Dutch businessman Tob Cohen.
According to a senior detective attached to the Directorate of Criminal Investigations (DCI), Judge Kantai held secret meetings with the late Cohen’s wife Sarah Wairimu.
The detective identified as John Gachomo revealed that the two met on several occasions at different places and planned for the businessman’s death.
Gachomo said that Kantai fully participated in murder of Cohen whose body was found in his home in Kitusuru Estate.
DCI further accused the Office of the Director of Public Prosecution of trying to stop investigations so that the judge could not be charged according to the court documents.
“The office of the DPP can only terminate criminal proceedings instituted by his office and not criminal investigations being undertaken by the DCI while exercising its constitutional mandate,” part of the court papers read.
Gachomo said that DCI believed that Kantai was part of the murder plans because he fraudulently transferred shares of a company that was being ran by Cohen to Silas Itas and eventually transfered them to Wairimu.
Gachomo said that the death of Cohen occurred two days later after the fraudulent transfer was discovered.
“Cohen was murdered barely two days after the discovery of the fraudulent transfer involving the petitioner and Wairimu. The discovery of the fraud is the motive of Cohens death,” the documents filed in court read.
Gachomo also said that the DCI had established that the judge heightened his communication with Wairimu who is the main suspect in the murder of Cohen.
Kantai however argued saying that he was in good terms with Cohen who was his client and had been his confidant to an extent of entrusting him with his investment, but DCI believe that there is no way Cohen would have granted Kantai shares of his company.
Detectives also believe that Wairimu was Kantai’s mistress even before Cohen’s death.
Cohen is said to have been murdered between July 19-20, 2019 and his body hidden in a septic tank in his compound.
