President Uhuru To Lose His Powers If He Doesn’t Appoint The Six Judges

The court on Thursday gave an ultimatum to president Uhuru Kenyatta that he should appoint the six judges failure to which he will lose those powers.

According to the court, the head of state has been ordered to appoint the six judges in the next 14 days failure to which they will be deemed duly appointed.

The judge ruled that failure by the president to appoint the six judges into office within the stipulated time will imply that his powers to appoint the members of the bench have long expired.

“That upon the lapse of the 14 days without the first respondent having made the appointments, it shall be presumed that his power to make them has expired and his office becomes functus as far as the appointments are concerned ad the six nominees shall be deemed duly appointed effective from the date of default as judges of the superior court for which they were recommended.

The six judges were amongst those recommended for promotion by the Judicial Service Commission (JSC) but president Uhuru Kenyatta was reluctant, citing corruption allegations against them.

As a result, only thirty  judges were appointed into office leaving the six outside after push and pulls.

However, today’s court ruling to forcefully appoint the six judges even without the input of president Uhuru Kenyatta drew mixed reactions from Kenyans as follows:

“This institution needs to be brought to order. Running rogue.”

“Uhuru is above the law, you are the law maintainer, who is the most high?”

“Prezo is immune to court orders.”

“The judges now rule this country. Awaiting when they shall order the sgr and the express way to be unrolled. Unconstitutional projects. Revenge gone too far?”

“A Coup instituted legally. Weaponizing the law.”

“Kenyan Courts r now run by mad people.”

“There must something fishy going on between the Judiciary and the Executive..Soon they are going to tell us that “our lives are null and void.”

“Ombudsman needed .. The judges in this country need a proper audit… We hear their scandals everytime.. Jsc doesn’t dismiss them.”

“Some of rulings and judgement being made buy judges is a cold war btw executive and judiciary. Not good for fairness and justice to this country.”

“The danger in having everyone as the boss, since when did we have a president of court and another president of hospitals another for jails and another one for prisons, this only shows the constitution has failed it’s mandate.”

“Coup in action which can create chaos in this Nation too much freedom is poison, what happened in south Africa on judiciary beef out with former president also last month in #Lebanon can happen also here, it’s good Kenya have a cool president. Those judges have dirty around them through #JSC. Kenya were angered by uhuru because of curfew now they have started to love him countrywide.Ngojea uone vile judiciary italipuliwa na wananchi.”

“We now have the best independent courts in Africa, kudos courageous judges.”

“Nonsense, courts can not force him to appoint corrupt judges.”

“Wah! The president is now subject to the judiciary? The constitution is now supreme. And the judges are now the almighty. What a country!”
