Nick Mwendwa Lawyers Fault Police Over His Re-arrest

LSK president Nelson Havi has refuted claims that embattled FKF boss Nick Mwendwa was arrested as reported by the media.

Instead, Havi said that Mwendwa was kidnapped and is being held at the Directorate of Criminal Investigations Headquarters.

The lawyer said that Mwendwa was being detained without charge even after being set free by the court.

“FKF President Nick Mwendwa is not under arrest. He has been kidnapped and is being detained without charge at the DCI Headquarters. The police cannot seize someone who the Court has freed for want of a charge. This egregious conduct by George Kinoti should be condemned,” Havi shared in a tweet.

Another of Mwendwa’s lawyer Eric Mutua termed his re-arrest as abuse of both police powers and the criminal justice system, whose aim was to intimidate the embattled FKF boss.

“The chronology of events shows a clear abuse of both police powers and the criminal justice system, whose ultimate aim is to intimidate our client in order for him to abandon his pursuit of a civil dispute over the management of FKF,” Mutua said.

He added that the police responsible for Mwendwa’s arrest will be held accountable for false imprisonment, unlawful confinement among other charges if they fail to release him.

“Note that unless our client is granted a cash bail, we shall hold you all concerned officers individually and or personally liable for false imprisonment, unlawful confinement, abuse of police powers, abuse of office and violation of rights,” Mutua said.

Mwendwa was arrested and detained at DCI headquarters on Friday. It is not clear why he was arrested again but reports indicate that his re-arrest is in relation to the ongoing investigation on misuse of funds at the federation.

This comes a day after the court closed his file case since the state failed to prefer charges against him.
