Lawyer Withdraws From Representing Officers Linked To Death Of Kianjokoma Brothers

Six police officers linked to the death of Kianjokoma siblings did not take plea in court after the lawyer representing them withdrew from the case.

The process had been scheduled for Tuesday August 31 was forced to be pushed to another day since it is mandatory that the suspects get a represented.

The plea-taking has now been scheduled for Thursday after Justice Daniel Ogembo directed that the suspects be allocated state lawyers by the registrar on Wednesday.

While postponing the case, Judge Ogembo said that it was important that the officers get represented by a lawyer.

“So I will allow this request by the suspects to get new lawyers. I will not allow them to be remanded at Industrial Area because it will make it hard for them to get advocates,” he said.

The judge however said that the officers are free to get their own lawyers if they wish to.

During the court session, only five officers appeared before the court with lawyer Danstan Omari who was representing them saying that the sixth suspect was unwell.

Initially, the officers were presented before Magistrate David Ndungi who ordered that they be detained for 14 days as police conclude their investigations.

LSK’s president Nelson Havi argued that the officers should just take plea since the 14 days lapsed today.

Officers Benson Mputhia, Consolata Kariuki who was unwell, Nicholas Cheruyoit, Martin Wanyama, Lilian Chemuna and James Mwaniki are accused of having a hand in death of 22-year old Benson Ndwiga and his 19-year old brother Emmanuel Ndwiga which occurred early August.

The two were discovered dead in a mortuary in Embu few days after they were arrested at the Kianjokoma shopping centre for flouting curfew rules.

The suspects will be remanded at Capitol Hill police station
