Lawyer Shocks Court By Claiming That He Was Contacted By The Deceased In A Murder Case

A lawyer shocked a court after claiming that he was contacted by the deceased whose murder case is ongoing.

Lawyer Brian Khaemba, who is representing Lucy Waithera, a suspect in the murder in the of a Belgian Dysseleer Mirielle Lesoipa alias Leila, said that the deceased is still alive.

The lawyer went ahead to present a screenshot of their early morning WhatsApp conversation whereby the deceased sent him ‘her’ photo.

Leila’s body has never been found since her murder in early last year and police believe that she was cremated.

According to Khaemba, the woman who contacted him said that the two women in the case, Waithera and a lawyer, are innocent and should be released.

The prosecution however argued that the information had not been verified. The message was also in a picture and not a video call.

The prosecution urged the court to proceed with the case since the claims of Leila being alive was just a move to derail the case.

Preliminary investigations indicated that the number that was used to communicate with Khaemba is not registered under the deceased’s name.

The number is said to be registered under the name of Newton Muendia of ID 35380572 and that it was moving around Nairobi.

“We are in the process of tracing the owner of the phone to record a statement and the lawyer should also record a statement at the nearest police station,” the state said.

Khaemba however told the court that he was shocked that the matter was being handled lightly.

“What if it’s true that the deceased is alive my Lord?” he posed.

He further said that he was helping the court in dispensing justice.

Leila went missing from her residence in Blankets estate, Mwariki, Nakuru East earlier in 2019.

Waithera was arrested onFebruary 1, 2020 in her residence in Milimani, Nakuru and the police recovered the deceased’s assorted bank cards and a copy of the death certificate.

Laywer Wandugi Kirathe asked the court to halt the matter since the deceased’s body was never found.

Justice Ogembo however asked Khaemba to file a report with investigative agencies who will file a report in court to verify his claims. The case whose trial began on Tuesday will proceed until the report is filed so that the court can issue directions concerning the matter.
