Kosewe Ranalo: Why Tom Mboya Won’t Spend 23 Years In Jail Despite The Ruling

Businessman Tom Mboya Oywa accused of attempting to murder Ranalo Foods restaurant owner William Osewe (Kosewe) has been sent to jail for a whopping 23 years.

According to the Milimani chief magistrate Martha Mutuku, Tom Mboya never showed any remorse and decided to sentence him to 23 years in jail having considered the probation report that was before the court.

“I have considered the probation report tabled before me and noted that the accused Tom Mboya never showed any remorse for his offence,” the magistrate said.

Magistrate Martha Mutuku further considered the impact that the attempt had on William Kosewe as she added that the criminal act still haunts him to date.

“I sentence the accused to 20 years in jail for the attempted murder charge and three years for wounding,” she ruled.

Despite that, the court ruled that Tom Mboya Oywa will only serve 20 years since the sentence will run concurrently.

Kosewe was represented by lawyer William Ongoro in  a case that saw the court declare the accused guilty because the prosecution proved its case beyond any reasonable doubts.

As a result, he was last week convicted of attempted murdered and wounding which happened sometime in 2016.

Oywa, a licensed firearm holder, was found guilty of attempting to kill the prominent hotelier when he opened fire on him at a restaurant on Thika Road in Nairobi, leaving him with serious injuries.

Apparently, the owner of Ranalo and Tom Oywa were involved in a melee after they fought over the former’s wife with Osewe accusing Oywa of  “feeding on his wife.”

While delivering the judgement, the magistrate noted that the offence of attempted murder is usually committed with an intention of killing the other person.

“I have considered the evidence before the court and it is undisputed that Mboya shot Osewe,” she said.

The court further noted that Tom Mboya Oywa fired at Kosewe several times as he shouted at him that he would kill him by firing bullets at him.
