Gachagua Changes Tune On Filing Petition Against Justice Esther Maina

DP Rigathi Gachagua had vowed to file a petition for the removal of Justice Esther Maina this Thursday at 2.15pm.

The second in command intended to go after the high court judge for declaring his fortune, Kshs202 million, as proceeds of corruption without giving him chance to defend himself.

He accused Justice Maina of misconduct and corruption.

On Thursday, this coming week at 2:15 pm, I will personally present a petition before Lady Chief Justice Martha Koome against Justice Esther Maina for her removal from the Judiciary for misconduct and corruption,” Gachagua said while in Elgeyo Marakwet last Sunday.

However, in a statement a while ago from from the head of deputy presidential communication service, Gachagua said that he would not be proceeding with action against Maina.

He changed course because of the recent calls for talks between the judiciary and executive by Chief Justice martha Koome.

“Deputy President Rigathi Gachagua notes the current national discourse on judicial transparency and application of Article 10 of the Constitution of Kenya on the conduct of Judges and other Judicial Officers. He welcomes the statement by Chief Justice Martha Koome inviting dialogue on the critical issue of accountability of the Judiciary, which H.E President William Ruto has embraced,” read his statement.

“In this regard, the Deputy President will not proceed with the matter of the petition, for now,” the statement further read.
