Foul Play? Kenyans Unconvinced With Reasons Why Babu Owino Was Acquitted Of Attempted Murder

Kenyans are not happy with the court’s ruling that freed Embakasi East MP Babu Owino of attempted murder charges.

Owino was accused of attempting to murder DJ Evolve whose real name is Felix Orinda after shooting him twice on the neck on January 17, 2020 at B-Club entertainment spot in Kilimani, Nairobi.

DJ Evolve filed an application to have the case against Owino withdrawn so that the matter could be settled out of court in October 2020 and in March this year, the court ordered a full disclosure of the reconciliation deal between duo.

In the ruling delivered on Tuesday, December 14, the court allowed the withdrawal of the case.

Milimani law courts magistrate Bernard Ochoi noted that DJ Evolve and Owino were friends before the shooting incident and noted the obligations that the lawmaker was currently undertaking regarding Evolve’s welfare

“Taking all the above into account I have come to the conclusion that this is a matter where the court should encourage reconciliation as envisaged in the constitution and therefore I will allow the withdrawal against the accused in count one, the accused is acquitted,” the magistrate ruled.

Speaking after the ruling, the MP expressed his gratitude to God for being on his side.

“I can just say God is so great. He has always been with me. He has never forsaken and never left me and I am thanking Him.

“There are a lot of things we agreed on medical and compensation of physical things. We agreed in the spirit of forgiveness. DJ Evolve’s family is my family and mine is his. DJ Evolve is my brother forever,” Owino said.

Kenyans are however not convinced that DJ Evolve would withdraw the case just like that after the life  threatening incident that saw him hospitalized for 6 months.

“Felix Orinda aka Dj Evolve withdrawing the case against Babu Owino implies two things; 1. He has fully recovered and is back to his job. 2. He is okay with his current situation. In both situations I wish him all the best and hope he will never bother Kenyans with a paybill,” General Waitina’s tweet read.

 

Shiroyal legal wrote,”The Babu Owino case was attempted murder. He didn’t care where he shot him. Felix Orinda was lucky enough to get shot on the leg. It’s a criminal case that the state is supposed to be prosecuting. How can the victim give a go ahead for acquittal? This is injustice!”

Emannuel Kiplet’s comment read, “Another criminal walking free in the streets making the loudest of noise. Felix Orinda.”

Owino however still faces the second charge of misuse of firearm.
