DPP Withdraws Case Against Siaya Priest Accused Of Spreading Coronavirus

The Catholic priest from Siaya who was charged with knowingly spreading coronavirus has been set free by a Nairobi court.

This comes after the DPP withdrew the charges against him following failure by the prosecution to produce witnesses during trail

“CCIO Kilimani has failed to produce witnesses in court nine times, making the court to adjourn the hearing of this case”, the court heard on Thursday.

State counsel James Machiral told the court that public interest in the matters was served in deterring negligent behaviour within the society that is likely to put the lives of others in danger.

The case was withdrawn under section 87A of the Criminal Procedure Act since the charges levelled against him could not hold.

The priest, Richard Oduor was arrested immediately after being discharged from Mbagathi Isolation centre, spent four days in police custody and the whole Easter holidays behind bars.

Richard flew into the country on March 10 from Italy, a country which had then registered the highest number of people infected with the coronavirus, but failed to self-quarantine.
