Karoney To Explain The Closure Of Regional Land Registries Before The Senate

The Senate has issued a summon to the Land and Physical Planning Cabinet Secretary Farida Karoney to appear before the House to shed light on arbitrary closure of Central and Nairobi land registries.

The call comes after the Senate was petitioned by the Kenya Private Sector Alliance (KEPSA) to intervene and conduct an investigation on the abolishment of the electronic land registration transaction regulations 2019 and the consistent unlawful implementation of the Land Information Management System (LIMS).

Karoney is also expected to answer questions on poor administration of land registries across the nation, owing to the inadequate and poorly trained staff at the ministry who ensure instruments are stamped with the correct value of stamp duty.

“There is an unprecedented rise in the number of cases of misplacement of records at the Lands Registry due to lack of a file tracking system at the Lands Registry and automation of the A-Book,” KEPSA Chief Executive Officer Carole Karuga says in the petition.

Carole Karuga added, there was a huge challenge in accessing the registrar something that resulted in inefficient and slow resolution of issues and long transactional periods.

According to Carole, there are situations where the land registrar needs the production of court proceedings to recognize the court orders. She argues that the procedure leads to delays in some transactions which have already been settled by the court.

“Despite, all the efforts and constant engagement by Law Society of Kenya who are members of KEPSA, there seems to be an unwillingness on the part of the Cabinet Secretary to work towards efficient and effective land administration and land administration processes,” a statement from KEPSA to the Senate read.

The body added that the shutting down of the land registries has affected their overall ranking in the global ease of conducting business index.
