A Nairobi based lawyer is seeking to have Roots party presidential candidate George Wajackoya barred from contesting in the August 9 general elections.
In a petition filed in court, the lawyer, identified as Bernard Okello Odero, argues that the manner in which prof Wajackoya conducts himself is likely to disgrace the office of the president.
He further said that his conduct often raises the question whether he is of sound mind.
Odero claims that the electoral Commission, IEBC, failed in subjecting the presidential candidate to a mental test to be certain that he is 100% okay before clearing him to vie for the position.
Aside from that, the lawyer says that Wajackoya’s 10-point manifesto is a clear violation of the law. Suspension of the constitution and hanging those found guilty of corruption are some of the things that he cited.
“This contravenes the constitutional provision of the right to life and freedom from inhuman and degrading treatment contrary to the international obligation of Kenya as ratified in various human rights treaties,” part of the petition read.
The lawyer further states that Wajackoya’s wife and children are fully American citizens and have not changed or acquired Kenyan citizenship thus contravening with the requirements for him to be cleared to vie for presidency.
“His children were all born in America and live in the United Kingdom where they are now citizens hence putting the allegiance of the 1st respondent as a requisite for vying for the position of the president in question as required under the constitution,” the petition further read.
Odero has listed Wajackoya as the first respondent in the petition and IEBC as the second. Interested parties in the case include NACADA, the British High Commission to Kenya and Kenya National Human Rights and Equality Commission.
