A 73-year old man from Birunda village in Saboti Sub County ,Trans Nzoia has sued his son over claims of neglecting him.
Gideon Kisira Cherowo moved to the Kitale Law Courts complaining that his son had left him to languish in poverty and was enjoying city life despite the sacrifice and investment he had put in him.
Cherowo, who filed the petition by himself, said that he could not afford to pay an attorney to represent him.
He said that he sold his piece of land to educate his son to the tertiary level and also gave him his inheritance, a quarter an acre of land, and blessed him before marriage.
Aside from that Cherowo says that he also paid his dowry that included an amount of money that he did not disclose, four cows and some other items.
According to the 73-year old, his son was employed by the government in Nairobi and enjoyed all the benefits that came with his employment all by himself.
“I used all the resources I had to enable him to be in a good position so that he can help our family. Right now, my wife and I are in a horrible state yet we have a son who is working,” the old man said.
The family had depended on the young man but he cut communication with them after leaving for Nairobi and efforts to solve the matter amicably have proved futile.
“I have tried several times, for years, to seek assistance from my son, but all in vain. He is the only one, out of my four children, who is gainfully employed,” Cherowo told the court.
Cherowo wants the court to compel his son to compensate him by providing him with money for the upkeep.
“I pray that since he has a good salary, I request 20 percent of his salary to be given to me as the father,” the father of four said.
He provided a witness, his younger son, who told the court that their brother abandoned them 17 years ago.
“We are living a very horrible life after the defendant consumed the very thing our father had, so as to take him to school,” he said.
The defendant is yet to respond to the petition as the court plans to set the date for the hearing of the case.
