Mama Ngina In Court Battle With Attorney General And Registrar Of Lands

The Attorney general and the Chief lands Registrar have been sued by former first lady Mama Ngina Kenyatta.

Mama Ngina and her partner former Taita Taveta MP Basil Criticos have dragged the government officials to court for failing to issue them with a title deed for a land that they jointly own in Taita Taveta.

The land in question measures 1062.3 hectares.

In the lawsuit, they have accused the land registrar of refusing and delaying to grant them the crucial document.

In his submissions to the court, Criticos says he and Mama Ngina owned the property jointly, before it was subdivided . They later subdivided the land and transferred the subdivisions  which were registered and given their respective certificate of title, with the 1062 hectares remaining.

Attempts to however obtain a certificate for the remaining land has however not been successful for a whole year.

‘The registration was proved by an entry No. 41 in the mother title LR No. 10287 confirming that a certificate of title LR 252528 had been issued on 18 October 2022. It is now over one year since the property was registered under the provisions of the land registration act, and the registrar has failed to issue to the applicants the said certificate of title,” he stated.

“The registrar is the custodian of the said documents and is the only person to explain why the applicants have been denied their said certificate of title,” they complainants further said.
Justice John Chigiti has labelled the matter urgent, allowing the he issues raised and to serve their motion within 14 days.
The accused persons will also have 14 days to respond.
