Renown lawyer Donald Kipkorir has threatened to take legal action against Muthaiga Country Club if they fail to address his grievances in five days.
In a demand letter to the club through his lawyers, Kipkorir lamented about being denied access to the premises despite frequenting the place for the past 25 years.
“Over the past 25 years, our client has been a frequent guest at Muthaiga Country Club where he has actively participated in luncheons and meetings upon invitations extended by his clients and friends who hold membership at the club,” his legal team stated.
Trouble with the club however began towards the end of last year when he was denied access on grounds that a member of the club had raised a complain against him. Since then, he has been denied access to the club on various occasions.
“Regrettably, our client informs us that this was not an isolated incident. On subsequent occasion, he has been denied entry to the club, causing him immense embarrassment and overwhelming ordeal of distress,” Manyonge Wanyama and Associates LLP said.
Aside from that, the legal team stated that Kipkorir’s dignity and reputation have been harmed and also his freedom of movement and accessing the club as a guest curtailed unjustly.
“The actions taken by the club riddled by a conspicuous lack of of transparency and due process have grossly infringed upon our client’s right to fair administrative action under article 47 of the constitution.”
Kipkorir is now demanding the club to disclose full details of the complain that has seen him denied access to Muthaiga country club.
He also wants access to communication and records related to the complain as well as an explanation of the drastic action that was taken against him without prior notification.
“Should you fail to heed to this demand within the next five days our instructions are to immediately pursue legal remedies available to protect the rights of our client at your peril as to costs and other attendant consequences,” the legal team concluded.
