Embattled Senior Counsel Ahmednasir Abdullahi was supposed to be in Supreme court this Tuesday defending his 94-year old client from Eldoret in an appeal.
The Eldoret family is involved in a battle with the late former President Daniel Arap Moi’s family over a Kshs2 billion piece of land.
Due to the ban that was imposed on him last week , Ahmednasir could however not represent the client and was forced to follow on the proceedings on the sidelines.
He is however glad that the Chief Justice Martha Koome was considerate with his client.
“I joined the Supreme Court proceedings on the “sidelines” this morning. I’m glad that @CJMarthaKoome , first gave my clients time to engage another lawyer and second to prioritise the hearing of the consolidated appeal due to the illness of Mama Cherubet Chelugui,” he said.
He later revealed that 6 judges of the supreme court declined to hear the case due to conflict of interest.
Ahmednasir added that he was willing to find a truce with the supreme court on two conditions;
“Now that@CJMarthaKoome today read the order of the Court where 6 judges recused themselves from the case I was to argue and further barring me from the court as long as they members of the Court.
“I’m ready to MAKE PEACE with the court as follows: 1. I will not take a brief or appear before the Supreme Court as long as CJ Koome, DCJ Mwilu, Smokin Wanja and Njoki are judges of the Supreme Court Kenya. 2. I will come back to the Court (InshaAllah) if and when Justices Ibrahim, Lenaola, Ouko and other new members constitute a majority in the Supreme Court,” he wrote.
The senior counsel was banned from the Supreme Court last week, as well as employees of his lawfirm, in what the court termed as incessant and unsubstantiated attacks.
Ahmednasir however vowed to challenge the ban in the East African Court in Arusha.
