A Nairobi court has given an investigating officer only seven days to record the statement of President Uhuru Kenyatta and ODM leader Raila Odinga cybercrime case.
The head of state and the former prime minister have been listed as complainants in a case where two suspects – Rading Ambogo and Magoma Ayonga were charged with the offense of unauthorized interception of computer data which is against the section 179(1) of the Computer Misuse and Cyber Crime Act.
Through lawyer Dunstan Omari, the court was informed that one of the suspects is apprehensive and psychologically traumatized and fears of his life.
“We requested a statement from the complainant who is the President of this country and Raila Odinga who were alleged to have been in the entourage,… to date those statements have not come,” the lawyer told the court.
The accused lawyer also requested they be given the original clip that captured the entourage on that particular day.
The case will be mentioned next week.
The two suspects are accused of intercepting Security CCTV footage capturing President Uhuru’s entourage on June 2 at around 8 pm along Kenyatta Avenue in Nairobi.
Through their lawyer, the suspects have rubbished the charge leveled against them saying it does not exist in the constitution.
“This alleged offense of intercepting a security CCTV does not exist in law. Our clients were never in the State House and have never gone to any government installation to take the CCTV footage of government,” the lawyer said.

The lawyer added that his clients are just mere casuals at a hotel in Nairobi.
The CCTV footage showed President Kenyatta and his handshake counterpart Raila Odinga inspecting development works done in the City center by the Nairobi Metropolitan Services (NMS).
