DPP Breaks Silence On Missing File On Aror And Kimwarer Dam Case

The Director of Public Prosecution(DPP) Noordin Haji has addressed reports about the missing file on the Aror and Kimwarer dam case.

According to a statement released by the Office of the Director of Public Prosecution on Thursday 23, 2021, the DPP denied claims that the file was missing.

He however admitted that the only file that had gone missing was about an application that had been filed at the High Court.

“The only missing file in this case relates to an application filed at the High Court by CMC Di Ravenna companies and their directors, a matter we have already responded to and are ready to prosecute at the earliest opportunity as when the date is set for hearing,” the statement reads.

This comes after the star newspaper wrote an article implying that the file on the case had gone missing.

The statement further states that the article was meant to mislead the public and raise suspicions on how the case is being handled.

“The ODPP wishes to clarify that this missing file is a court file in custody of the court’s registry and the article in The Star misrepresents the facts,” reads the statement that was signed by the Senior Director Public Prosecution, Alex Muteti.

Haji said that his office intends to officially raise the matter with the Office of the Chief Justice so as to ensure that the accurate position is clarified beyond peradventure and to avoid unnecessary speculation.

The case stalled on Monday after it emerged that the file with documents challenging the prosecution of Italian firm CMC Di Ravenna boss could not be traced.

The Italian companies that were dragged into the Ksh63 billion Arror and Kimwarer dams scandals have sued Kenya in the International Court of Arbitration.
