Sirisia Member of Parliament John Waluke has been barred from travelling to the US for a parliamentary function.
Waluke was blocked from travelling abroad for the much anticipated event due to a series of court cases against him.
In a ruling delivered on Thursday October 28, the court refused to release Waluke’s passport.
Justice Esther Maina described the lawmaker as a convict who cannot be allowed to leave the country while giving her judgement on the application filed by Waluke.
For one to be allowed in the US, he/she must have a valid passport or visa.
The MP’s troubles began when he was found guilty, together with his co-accused Grace Wakhungu, of the theft of 297 million from the National Cereals and Produce Board (NCPB).
The Anti-corruption court sentenced Waluke to 34 years in jail while Wakhungu received a 39-year jail term. They were given an alternative fine of Kshs2 billion.
The two however found reprieve in September 2020 after the High Court in Nairobi approved their release on bond pending the hearing and determination of their appeal on their jail sentence .
Waluke is out of jail on a 10 million bail while Wakhungu was released on Ksh20 million cash bail or an alternative Ksh30 million bond.
Some of the conditions they were given during their release included surrendering their passports to court. They were also told to report to the High Court’s deputy register every month.
Early this month the Ethic and Anti-Corruption Commission threatened to take action against the MP and his Kimilili counterpart Didmus Barasa for masquerading as military officers.
This is because the two had become fond of using titles of Major (rtd) and Captain respectively even though they left the forces.
EACC said that the duo left the forces without even acquiring the titles.
