Police officer Duncan Ndiema who shot and killed a 13-year-old Yassin Moyo in Kiamaiko has been released.
The officer had earlier on pleaded not guilty to the murder of Moyo and remanded at Capitol Hill Police Station pending the hearing of his bail application.
Duncan Ndiema has paid a cash bail of KShs. 1 million two weeks after he pleaded not guilty.
The court directed Ndiema to not interfere with the witnesses and also provide two contacts who are close to him, preferably close relatives.
Ndiema appeared before High Court Judge Luka Kimaru on June 23, 2020, and was charged with the murder of Yassin Moyo.
The High Court had earlier deferred his plea taking after his lawyer said that the officer had been admitted to the Mbagathi Hospital pending the results of a coronavirus test.
“…as the investigating officer having received the orders from the court proceeded to Mbagathi and received information from the management of the hospital that they had not treated the accused that day as alleged,” read the application.
The investigating officer told the court that Ndiema was never at the aforementioned hospital but was instead in Uthiru and Ndumbuini areas, around 15 kilometers from the hospital.
