City Lawyer Admits To Filing Petition Challenging Kinoti Jail Sentence Without His Consent

A city lawyer is in trouble for filing a petition in the name of DCI boss George Kinoti to challenge the 4-month jail term.

Kinoti was sentenced to jail for the said period at Kamiti Maximum Prison over contempt of court in a firearms case involving businessman Jimmi Wanjigi.

The lawyer, Calvin Koome, seized the opportunity to appeal the ruling by Judge Antony Mrima on Thursday, November 18,  and filed a petition in Kinoti’s name.

The High Court ordered the Law Society of Kenya (LSK) and Directorate of Criminal Investigations (DCI) to investigate the lawyer for imposing the DCI boss.

This is after he admitted that he had not been directed by Kinoti or the Attorney General to file the appeal.

“I had no direct instructions from the DCI. I had instructions from a proxy,” Koome said.

He further told the court that he had used another law firm’s letter head in the petition without their consent.

Owino McDowell & co. Advocates have since distanced themselves from the matter saying that saying that they did not authorise the lawyer to use their address in filing the petition.

The appeal was however dismissed by Justice Antony Kimani of the judicial review division who said that the petition had been filed irregularly after Kinoti denied knowledge of the suit.

DCI distanced itself from the petition saying that it had been filed without the knowledge of Kinoti.

“It has come to the attention of the Director of Criminal Investigations that a case namely HCJR 163/2021 has been filed on his behalf and the same is on the cause list to be mentioned on Monday, November 22, at 2 pm before Justice Anthony Kimani Ndung’u, at the Milimani Law Courts.

“This is to make it very clear that the Director of Criminal Investigations George Kinoti, has not instructed anybody to file a suit on his behalf or on behalf of the Directorate of Criminal Investigations,” DCI statement read.
