Law Society of Kenya president Nelson Havi has said that anything that the Directorate of Criminal Investigation (DCI) boss George Kinoti does as of yesterday will be null and void.
According to Nelson Havi, Geroge Kinoti will not present himself to the Kamiti Maximum prison to serve his sentencing because he is not a law abiding citizen.
As a result, the Law Society of Kenya president said that Kinoti has no moral authority to put on a suit or investigate anything by virtue of being a convict.
“Look, Kinoti will not accept to present himself in Kamiti. Of course he presented himself in Kamiti yesterday and the name was wacha niende hivi nitakam. As we speak Kinoti is a convict, he is a convict.
“He has no moral authority to put on a suit. He must shave his beards, he must shave his hair and he must put on the white strapped attire and remain Kamiti. Anything he does effective yesterday is null and void.
“But your guess is as good as mine. The inspector general of police will not enforce the warrant against Kinoti. But this is something that must alarm us. Kinoti’s predecessor Ndegwa Muhoro was a very law abiding Directorate of Criminal Investigations. I remember when he was directed by justice Luka Kimaru to come to court and explain what efforts the police have made towards ensuring that Willy Kimani is traced.
“He came to court and he patiently sat for four hours and listened and assisted the court. Now for what reason has Justice Mirima directed that George Kinoti serve a four months sentence? It’s very simple: he was asked to come to court and explain why he has not surrendered the firearm of Jimmy Wanjigi. What is difficult about that?
“Who does he think he is? Other than the firearm that the police hold as a tool of coercion, they are very powerless because they are enabled by the court process. Warrants are issued by the courts, sentences are issued by the courts, convictions are issued by the courts, orders to detain somebody are issued by the courts.” Said Havi while speaking to the Tackle.
The Director of Criminal Investigations George Kinoti was on Thursday sentenced to four months in jail at Kamiti Maximum Prison for Contempt of court.
This is after the DCI boss ignored a court order requiring him to return guns he confiscated from businessman and presidential hopeful Jimmi Wanjigi on October 16, 2017.
The order was issued by Judge Chacha Mwita on June 21, 2019. Judge Mwita asked Kinoti to return 7 firearms that had been taken from Wanjigi’s home in Muthaiga.
“The plaintiff’s rights were violated by the respondents. The actions of the respondents were unlawful and actuated by malice. The court grants orders that all firearms be returned to the plaintiff,” Justice Mwita ruled.
The businessman told the court that the police searched his house without a warrant. He argued that there was no proof that he had misused his guns and that he had not been charged in any court for crime.
In September this year Kinoti skipped a court hearing for sentencing after he was declared guilty for Contempt of court following a lawsuit that was filed by Wanjigi.
