Agriculture and Livestock Development CS nominee Mithika Linturi is a happy man after the attempted rape charges against him were withdrawn from court.
Beryl Akoth, the woman who had filed a complaint against the former Meru senator reportedly withdrew the case on Monday morning.
The case was withdrawn following the agreement that was reached upon by the complainant and the accused person. The two parties agreed to settle the matter out of court and Akoth swore an affidavit on withdrawing charges on September 21, just a week before President William Ruto named Linturi as among those he had appointed for Cabinet Secretary positions.
Chief Magistrate Susan Shitubi accepted the withdrawal after the Director of Public Prosecution confirmed that the parties had reached an agreement.
Akoth also confirmed to the court that she was not forced to make the decision and that she voluntarily made the decision. In her affidavit, she swore not to file charges against Linturi in future.
Linturi was facing charges of trying to commit an indecent act with an adult without consent, attempted rape among others. He was released on Kshs200, 000 bail. The court has now directed that his money is refunded as well as another Kshs 200,000 that was with the police as exhibit.
Netizens however have failed to believe that the complainant willingly withdrew the charges. Some claim that she was either offered a huge sum of money while others say that the case against Linturi was bound to be terminated because he was close to power.
In her complaint, Akoth had stated that Linturi sneaked into her hotel room in Mayian Villas hotel, Nanyuki, on the night of January 30, 2021 at around 3am. She had booked the hotel room with her husband but her husband was yet to retire to bed when the incident happened.
