The Azimio presidential candidate Raila Odinga lost to president elect William Ruto on the issue one of determination at the supreme court of Kenya.
Issue number one was whether the technology deployed by the IEBC for the conduct of the 2022 general elections met the standard of integrity, verifiability, security and transparency to guarantee accurate and verifiable results.
While rendering the ruling on Monday, Martha Koome ruled that they were not convinced that the technology deployed by the Independent Electoral and Boundaries Commission did not meet the integrity test. The chief justice further added that no credible evidence was produced by the petitioners in court. Consequently, they dismissed the prayer.
The supreme court further ruled that the allegations by Raila Odinga that there were staging of forms of 34As by a middle man who was interfering with them at Karen as claimed by John Githongo.
The court further ruled that the postponement of the election did not suppress voters as argued by the petitioners.
“It has not been shown that by postponing the lections in those places, IEBC acted in bad faith. We are satisfied that the postponement was due to a genuine mistake by IEBC. In the absence of any empirical data, we cannot conclude that the first petitioner suffered the consequences.”
