The former prime minister Raila Odinga and his running mate Martha Karua have eventually filed a petition challenging William Ruto’s victory in the August 9 general elections at the Supreme Court.
In the petition, IEBC has been mentioned as the first respondent. Wafula Chebukati as the second, each of the remaining 6 commissioners of IEBC and William Ruto as the 9th respondent.
In the 72-page long petition titled The People’s petition, Raila and Karua have given a list of things they are seeking to achieve from the Supreme Court.
The petitioners want IEBC and Chebukati to avail all the material used in the presidential elections including; electronic documents, devices and equipment within 48 hours of filing the petition.
Aside from that, they want access to absolutely all IEBC servers for the purposes of inspection.
They are further seeking to have the Supreme court order DCI to produce materials(Photographs, statements, laptops etc) related to elections that the three Venezuelans arrested at JKIA were in possession of.
They also want DCI to produce materials and a laptop seized from UDA agent Kipkoech Geoffrey, which should be subjected to forensic analysis.
Karua and Raila are also seeking to have the spoiled votes and rejected ones scrutinized as well as forms 34A,B and C.
They want the Supreme Court to nullify the declaration of Ruto as the president elect.
“An order is hereby made consequent upon the nullification of the declaration of the results by the 2nd respondent(Chebukati) directing the first respondent to tally and verify the county and declare the 1st and 2nd petitioners as duly elected as President elect and Deputy President elect,” part iof the petition read.
The duo have accused IEBC chairman Wafula Chebukati and IEBC of being unable to conduct a free and fair elections in line with the constitution. According to the petitioners, Chebukati is unfit to hold public office citing his fallout with commissioners in 2017 and 2022 general elections.
Raila and Karua said that IEBC, Chebukati and two other commissioners who did not distance themselves from the presidential results and Ruto, jointly rigged elections.
The petitioner are also seeking to have IEBC, Chebukati and Ruto to bear the cost of the election petition.
