From Presenting A Woman’s ID To NYS Scandal, Why EACC Wants Top Politicians Out Of August 9 Polls

The Ethics and Anti-Corruption Commission(EACC) has identified 241 political aspirants that should be barred from vying in the August 9 general elections.

EACC selected the 241 individuals from a list of 21,863 aspirants saying that they have integrity issues.

According to a letter from EACC CEO Twalib Mbarak to IEBC CEO Marjan Hussein, some of  the individuals in question have been convicted, others have pending cases in court. Some generally failed the integrity test while others did not resign from their jobs by February 9 as required by the law.

The names of the individuals were forwarded to IEBC so that the commission should not clear them to vie for elective positions.

“Requirements for a person to qualify as a candidate for different elective positions are set out in various laws including the Constitution, Elections Act, Leadership and Integrity Act and various subsidiary legislation which these aspirants have not met,” said Mbarak.

The list includes 2 presidential aspirants, one deputy president hopeful, 61 gubernatorial aspirants and deputy governor hopefuls, 6 senatorial aspirants, 19 women reps hopeful, 58 candidates aspiring to be MPs and 94 MCA aspirants.

On the presidential list is embattled Murang’a governor Mwangi Wa Iria, whom IEBC declined to clear for failing to meet some of the requirements. 

The Usawa Kwa Wote party leader is accused of obstructing EACC investigators who were investigating him and destruction of evidence. He further has a pending asset recovery case of  Kshs542, which are suspected to be proceeds of crime.

Justus Juma, the presidential candidate Justice and Freedom party was flagged for submitting someone else’s ID, whose details belong to a woman. His application had however been rejected.

Kirinyaga governor Anne Waiguru, Former Nairobi governors Evans Kidero and Mike Sonko, Tharaka Nithi governor Muthomi Njuki, Tana River governor Dadho Godhana and former Petroleum CS John Munyes (Turkana gubernatorial seat) are among those eyeing gubernatorial positions. 

Waiguru has been flagged over the irregular payment of imprests which was subject to her impeachment proceedings and Kshs52 million corruption allegations. Both cases are awaiting action from the Director of public prosecution.

Kidero, who is eying the Homa Bay seat, has a pending corruption and asset recovery case in court.

Sonko on the other hand is seeking the Mombasa gubernatorial seat. He was impeached as Nairobi governor and has a pending case on economic crimes.

Njuki, who was barred from accessing his office in 2020, was charged with abuse of office and also has a pending corruption case.

On the senatorial list is Karungo Thangwa of Kiambu who was impeached as Kiambu CEC. There is also a court order barring IEBC from clearing him. 

Migori governor Okoth Obado is eyeing the senatorial seat of his county. He also has enough trouble on his neck. The governor has a murder case in court. He also has a pending corruption case and an assets recovery one.

There is the former Youth PS Lilian Omollo, who was cleared for the Embu senatorial race. She was charged with the NYS scandal over the graft of Kshs 467 million and has several bank accounts frozen.

Others in the list are Richard Onyonka of Kisii, Benjamin Kai of Kilifi and Dansan Mungatana who is eyeing the Tana River’s Senator seat.

Those eyeing MP seats and have been flagged by EACC include Kimili MP Didmus Barasa, Kitutuchache North MP Jimmy Angwenyi, John Waluke(Sirisia) who was convicted over corruption at NCPB, Oscar Sudi(Kapseret), Sospeter Ojampong(Busia governor) and Machakos governor Alfred Mutua who is said to be eyeing the Mwala parliamentary seat.
