Nominated Senator Isaac Mwaura has been readmitted back to the senate after the high court nullified his expulsion from Jubilee.
According to the Senate speaker Ken Lusaka, he was obligated to readmit Mwaura following the court’s decision.
“The High Court having quashed Gazette notice number 4597 by the Speaker of the Senate that declared a vacancy of a member elected through a party list, thereby removing senator (Dr) Isaac Mwaura as a senator,
“And further the High Court having quashed the gazette notice no. 4598 dated May 11, 2021, by the chairperson of IEBC which appointed Mr Sammy Prisa Leshore to replace Isaac Mwaura as a member of the senate representing PWDs, I therefore direct that Isaac Mwaura Maigua, CBS, MP, remains as Senator in accordance with the Constitution of Kenya and the Senate Standing Orders, Lusaka said on Wednesday.
Mwaura was expelled from Jubilee over allegations of violating the party’s constitution and contravening the code of conduct. The decision was affirmed by the Political Parties Disputes Tribunal.
“It is notified for the information of the public that pursuant to Article103 (1) (e) (i) of the Constitution and section 37 of the Elections Act, the seat of the Member of the Senate elected under Article 98 (1) (d) of the Constitution and held by Hon. Isaac Mwaura Maigua became vacant, with effect from the 7th May 2021,” speaker Lusaka said in a gazette notice.
The ruling party intended to replace him with Sammy Leshore but he was never sworn in following a court order.
Last Thursday, Justice Joseph Sergon found that the tribunal failed to prove Mwaura’s disloyalty.
The judge further said that the tribunal was wrong in ruling that Jubilee was justified to punish the Jubilee senator.
Mwaura was escorted back to the chambers by Deputy President William Ruto’s allies. including; Naomi Waqo (nominated), Falhada Iman (nominated) and Christopher Langat (Bomet).
