Reprieve For Nick Mwendwa As Court Closes Case Against Him

Embattled FKF boss Nick Mwendwa is a happy man after the court closed the case against him on misappropriation of funds.

In a ruling delivered on Thursday, November 25, the court closed the case and ordered that Kshs4 million that Mwendwa had deposited for his release on bail be refunded.

This is after the state failed to prefer charges against him within 7 days as the court had directed last week.

The matter came up for mentioning in court on Thursday whereby the state said it wishes to close the file pending further investigations into the matter.

“We seek to close the file for the time being as we proceed with investigations before we prefer charges against him,” state prosecutor Everlyn Onunga told Miliamni Senior Principal Magistrate Wandia Nyamu.

The magistrate granted the prosecution the request to have the case closed.

“I therefore order this matter closed as prayed by the DPP, ” the magistrate ruled.

Mwendwa was represented by former Law Society of Kenya presidents Eric Mutua and Professor Tom Ojienda, current LSK President Nelson Havi and veteran lawyer John Khaminwa,

His legal team however did not oppose the prosecution’s request to have the case closed in the meantime.

Mwendwa was arrested and detained over allegations of corruption and fraudulent acquisition of public funds after sports CS Amina Mohamed received an audit report that was conducted on the federation last month.

CS Amina further disbanded the FKF board and appointed a caretaker committee to take charge of football matters in the country.
