Gatundu South MP, Moses Kuria has slammed Chief Justice David Maraga over his advisory to the president to dissolve the Parliament over failure to enact the two-thirds gender rules.
Moses Kuria told Maraga that he has made the most “fatal mistake with only 100 days left in the office”.
“My good friend David Kenani Maraga has made the most fatal mistake with only 100 days left in office,” Kuria said.
Kuria said, throughout his term parliament, the two-thirds gender rule has been brought to the flour and been voted severally.
And during those times, Kuria said he has voted ‘NO’ adding that it “it comes up again I will vote “NO”.
On Monday Chief Justice David Maraga advised President Uhuru Kenyatta to dissolve Parliament for failing to enact legislation required to implement the two-thirds gender rule.
In the advisory, the CJ was responding to six petitions seeking his advice on the matter.
“The petitions are based on the ground that despite four court orders compelling Parliament to enact the legislation… Parliament has blatantly failed, refused, or neglected to do so….” Maraga said.
Moses Kuria dismissed the claim noting that saying the law is not enforceable.
“Which constituencies will be reserved for men and which one will be reserved women? It (the law) increases the size of the National Assembly from 349 to 650 on account of gender only not even to cater for constituencies like Ruiru with 160,000 registered voters,” the MP said.
“More importantly the women I represent told me extra nominations for handbag carrying, perennial seminar attendees are not a priority over water, roads, schools, hospitals, and fertilizers.”
Kuria explained that when the matter went to parliament, they did not refuse to vote but “we voted with our conscience”.
“The constitution cannot force me to vote “YES” while my conscience wants to vote “NO”. Otherwise, why didn’t we put this clause in the constitution expressly if that was the intention?” Kuria posed.

Kuria noted that the Constitution vs Conscience question is the biggest “constitutional issue of our times”.
“The Constitution vs Conscience question requires a 5 judge High Court Bench and a fully constituted Supreme Court to rule on whether a constituted can overpower the people of Gatundu South whom I represent and my conscience to force me to vote in a certain way.”
“Until that happens bwana CJ I wish you well as you retire in the next 100 days. To President Uhuru Kenyatta, on the small matter of dissolving parliament, kindly wait until you hear from me,” Kuria said.
