Woman Sues Attorney General Paul Kihara Over Conjugal Rights

A woman has sued the Attorney General Paul Kihara over lack of conjugal rights following the imprisonment of her husband.

According to the court documents, the woman wants to be allowed to visit her husband, Erastus Odhiambo, in prison for conjugal rights.

Odhiambo was sentenced to jail for 20 years in 2018 after he was found guilty of the murder of a lawyer, identified as Linda Wanjiku.

Through her lawyer, the woman argues that even though her husband is in jail, he retains all his other rights, the conjugal ones being among them.

She claims that she has been deprived of her rights to procreate and have intimacy with her imprisoned husband.

“The first petitioner is in her reproductive years and it is her desire to sire more children, continue being a woman and now seeks for conjugal visits with her spouse to meet her sexual needs,” her lawyer said.

The lawyer further argues that failure by the respondent to facilitate the petitioner to access conjugal visits will be a violation of her basic need.

“The first petitioner has read and understood the content and substance in the Persons Deprived of Liberty Act 2014 and strongly believes that she is entitled to conjugal visits since her spouse retains all the rights under Article 51 of the Constitution.

“Failure by the respondent to accord, provide facilities to enable the first petitioner access such visits elucidated above amounts to a violation of her most basic need as a woman,” the petition reads.
