The High Court has declined to suspend the controversial affordable housing levy, that deducts 1.5% of gross salary.
The ruling on the matter was delivered by Justices Olga Sewe, John Chigiti and Josephine Mong’are.
“We are convinced that public interest sits in the favor of not granting the orders but prioritise this petition and hearing. The final orders are that we issue that the application dated April 2 and April 8, be hereby dismisses fir lack of merit,” the three-bench judge ruled.
A petitioner, Magare Gikenyi moved to court seeking to challenge the Affordable Housing Act 2024.
He termed the Act as discriminatory to corporates. He said that the Act outlawed corporations from owning a house despite them paying taxes and contributing to Kenya’s economy.
He further argued that not all Kenyans should be subjected to the levy as not all of them wanted houses .
