The court has barred Hustler nation spokesperson Dennis Itumbi from making remarks or publishing any content about a Nairobi based businessman.
Mike Maina Kamau sued Itumbi for defamation after he associated him with DP Wiliam Ruto’s United Democratic Alliance (UDA).
Itumbi claimed that Maina mobilized 3,500 employees to vote for UDA candidate in the Kimbaa by-election even after being paid by the deep state through a publication.
“A temporary injunction be and is hereby issued for 30 days from September 24, directed at the defendant (Itumbi) restraining him from making any defamatory statements and or making any defamatory publications in reference to the plaintiff (Maina),” judge Jaden Thuranira ruled.
In his lawsuit, Maina said that the publication was meant to ruin his reputation as a businessman.
“Our instructions are that the said publication was maliciously calculated to disparage our client in his character as an astute businessman. The malicious intent is palpable in the fact that the publication was not premised on any ascertainable facts,” Maina said through his lawyer Ochieng’ Oduor stated.
The businessman further said that Itumbi’s publication had no facts and caused him a lot of damage.
“As a consequence of this our client has been brought to pubic hatred, pillory, ridicule, contempt, odium and will be disgraced, humiliated, subjected to untold embarrassment and ostracized for which he holds you liable,” he added.
Before filing the suit, the tycoon had formally demanded that Itumbi pulls down the post on September 22.
This comes just days after the court found that Itumbi had a case to answer regarding a fake letter plotting the assassination of the Deputy President William Ruto.
Itumbi is accused alongside blogger Samwel Gateri for allegedly publishing a letter dated May 30, 2019 with the intention of causing anxiety to the public.
