Amani National Congress leader Musalia Mudavadi was on Monday forced to distance himself from the leadership of his ANC party to survive the parliamentary vetting.
Musalia was put to task by the Ugunja member of parliament Opiyo Wandayi to explain why he was being appointed in an illegal position not provided in the constitution.
Wandayi argued during vetting that the ruling regime had breached the law since no law had been amended in parliament to introduce the position in the government structure.
“The honorable Mudavadi and notwithstanding the ruling by the speaker a while ago, you obviously know that in the coalition agreement that you entered within the Kenya Kwanza Alliance, you did appreciate the fact that the position to which you have been nominated did not or does not exist as we speak. And that’s why in the agreement, there was a commitment that within 30 days, a legislation would be presented in parliament to provide greater legal clarity on the position, roles and functions of the prime cabinet secretary.” said wandayi, adding that no such an amendment had been made and that the Kenya Kwanza government was engaging in an illegality as far as he was concerned.”
Feeling cornered, Musalia Mudavadi agreed with Wandayi that indeed they entered a coalition agreement although he made it clear that he was no longer in the leadership of the ANC party.
The claim by Mudavadi that he was no longer the ANC party leader did not however go well with his followers who accused him of making a convenient statement just to get the prime cabinet secretary job.
Going by his statement that he was nolonger the ANC leader, it might as well imply that the agreement between the ANC and the UDA to first amend the law to introduce the prime CS position does not apply to him.
At the same time, Musalia was put to task to explain why the sudden change of tune and accepting the position despite castigating the handshake duo that they were hellbent on creating positions for themselves.
