Mathira MP Rigathi Gachagua together with Nyeri Governor Mutahi Kahiga failed to appear in court as it had been expected so as to provide information regarding the death of Governor Wahome Gakuru.
The two were to appear before Nyeri Principal Magistrate Wendy Kagendo on Thursday, September 23, to answer questions on the accident that claimed Gakuru’s life in 2017.
They however said that they skipped the court session because they had not been served with court orders requesting them to appear before the court so as to shed light on the matter.
The magistrate excused them while giving them a month to prepare and file their statements on the issue.
The court summoned Gachagua, after it was established that he called for an audit on the use of funds before the governor’s death, some of which he said were misappropriated during the late governor Nderitu Gachagua’s era.
Kahiga on his side was summoned after Gakuru’s family lawyer Mary Waweru pushed for his appearance since he was the beneficiary of the governor’s death.
Four police officers who attended to the scene of the accident however appeared before the court and recorded their statements.
The four, Sergent John Wanami, Sergent Martin Simiyu, Corporal Francis Kisavi, and Police Constable John Kivuva, were summoned by the court after they failed to show up when the case came up for hearing and site visit at Makenji in the Kabati area, where the accident occurred.
“The four officers were aware of the case, in fact, summons have been issued and as such, I apply for their warrant of apprehension for them to explain what happened in a professional manner,” said Prosecutor Kennedy Magoma while applying for their apprehension for disobeying the court order.
The four urged the court revoke their summon warrants since they had honored them, a request that was not objected by Gakuru’s family.
