Mahat Somane, who is part of the legal team that is representing IEBC, admitted to one of the commission’s mistakes that might have compromised the 2022 general elections.
While responding to a submission by Raila Odinga’s lawyer Julie Soweto, Mahat confirmed that there were two KIEMs kits that had the same serial number.
“We have been told there are two KIEMs kits which had the same serial number and we understood our role in this court was to give all the information for the court to make a decision. We admit that the KIEMs kits had the same serial number, an error that originated at the time of serialization,” the lawyer said
Mahat however explained that the kits had different identifiers that could not bring confusion as Soweto had submitted in court.
“We want to tell the court that those KIEMs have different IMEI, different IP addresses, they were for different polling stations,” the lawyer said.
He added that the KIEMs kit in question will be presented to court as well as the results transmitted by them so that they can be analyzed.
While giving her submissions in court, Soweto said that the same KIEMS kit in question were transmitting results from Mt. Elgon and Nyeri.
“This is the same KIEMS kit transmitting and sending results, one from Mt. Elgon, 1,000km away from Nyeri town. How is that possible when each polling station had its KIEMS kits with a unique IP address?” Soweto posed.
