A man was fined Kshs5,000 or a jail term of 5 months by the Kibera Law Courts for threatening to make love to a fellow man and his mother.
Wako Dida was given two weeks to appeal to the ruling by Senior Principal Magistrate Esther Boke if he was not satisfied.
Dida was arraigned in court and charged with causing public disturbance after efforts by the elders of the Borana community to solve the issue between him and the victim, Jarsob Gimda Roba, failed to bear fruits.
According to the prosecutor Nancy Kerubo, the accused repeatedly threatened to make love to Roba as well as his mother.
“This happened within Deep Sea Slums within Parklands in Nairobi County, when the victim was approached by the suspect who uttered the abusive words to him,” Kerubo told the court.
It however remains unclear what could have led to the verbal altercation that continued forcing the victim to report the matter at Parklands police station.
Dida pleaded guilty to the charges against him. He requested the court to forgive him promising that he would not repeat the mistake.
In a separate court case, a woman who was accused of recruiting young girls to prostitution has been found guilty.
Pamela Otieno Olunga was however not in court when the judgement was made. The court issued a warrant of arrest against her so that she could be detained as she awaits her sentence.
Pamela is said to have procured a 20-year old woman from Kariobangi for her business in July. She was also accused of enticing 3 other girls to the prostitution business by paying them Kshs500.
Birth certificates for the underage girls were provided in court to support the case against Pamela.
After the trial was concluded, the court said it was satisfied with the evidence presented by the prosecution.
The evidence clearly showed victims on the street donning provocative skin-tight and crop tops. They would also go to clubs and dance suggestively, an indicator that the accused was grooming them to look appealing for the purpose of attracting customers.
According to the court, an individual who controls the activities of another person relating and does so for or in expectations of gain for him or herself or a third person is guilty of an offense and is liable upon conviction to imprisonment for a term of not less than five years or to a fine of Sh500,000 or to both.
“Having considered all the evidence and the circumstances of the case as presented before me, I find the accused guilty of benefiting from child prostitution contrary to section 15 (b) of the sexual offenses Act and the charge of intentionally causing or inciting another person to become a prostitute,” the magistrate ruled.
The sentence will be delivered on December 3.
