Veteran lawyer Philip Murgor raised the issue of the Venezuelan hackers which came back to haunt the Independent Electoral and Boundaries Commission at the Supreme court.
Lawyer Philip Murgor while making his submission at the supreme court said that the IEBC system was not secure since they were accessed by illegal personalities.
According to Philip Murgor, forms 34As were deleted at the IEBC portal and replaced by others to give the results that were desired by the commission.
To strengthen his point, he talked about the variance in the results of forms 34Cs and those of the forms 34As. More shockingly, forms 34Cs were generated two days away from the final announcement and before tallying came to an end.
He claimed that the generation of the results was to be forward moving (i.e from polling stations by first generating forms 34As) as opposed to backward moving (i.e beginning with generation of 34Cs then adjusting downwards to 34Bs and 34As). Consequently, he wondered why forms 34Cs were first generated in the system and where the results came from.
The lawyer also made reference to the Directorate of Criminal Investigation (DCI) statement where they arrested the Venezuelan citizens and according to him, he believes that the IEBC server was accessed by unauthorized persons and foreigners.
Interestingly, the lawyer went ahead to drag Chebukati’s personal Assistant for illegally accessing the IEBC system. This was part of his submission: “Wafula Chebukati’s personal assistant Mr Dickson Kwanusu was granted access to IEBC system but he is not gazetted. So he is invisible. If we had not brought the logs, it would never have been known that he had access to the servers and what he did in those servers.”
