Lawyer Harun Ndubi to be auctioned over Sh. 414,000 rent arrears

Lawyer Harun Ndubi is now fighting an eviction and auction move by his landlord over rent arrears amounting to close to half a million shillings.

The lawyer has moved to court seeking an order to stop his landlord from evicting him from his house in Kilimani and selling his property to recover the unpaid rent amounting to Sh. 414,000.

In a case certified as urgent by Justice Weldon Korir, Lawyer Ndubi says that his landlord, Young Muslim Association (YAM) has instructed auctioneers to throw him out of his apartment on Kirichwa Road and seize his household goods over rent arrears amounting to Sh. 414,715. The auctioneers tasked to execute the move are Benwill Auctioneers. Once the eviction and auction is completed, Ndubi says that he is required to pay their fees of Sh.150,000.

Ndubi has been given a 14-day notice of July 9 after which his goods will be seized and auctioned off.

“He started defaulting from March 2020, when Chief Justice announced closure of courts to contain the spread of coronavirus. The lawyer said he received a call on July 18, from the auctioneer threatening to seize his household goods.

Mr Ndubi said he moved into the house seven years ago and the initial rent was Sh. 60,000 but the landlord increased it to Sh. 70,000 inclusive of service charge of Sh. 10,000 in 2012,” a report that appeared in the Business Daily on the matter said.
