The Independent Electoral and Boundaries (IEBC) lawyers were on Friday confused as they sided with the petitioners that indeed the chairman Wafula Chebukati was not to act alone.
The first lawyer representing the respondents admitted that the constitution does not give Chebukati room to act alone without involving the chairman.
However, this response was not clear since they spent the better part of Thursday arguing that Chebukati was within his rights to act alone and declare the ninth petitioner as the winner.
The IEBC lawyers also cleverly avoided the question about voter turnout as they argued that it was not very important to arrive at the winner in any election.
This response left many wondering whether the IEBC lawyer knew what he was talking about or if he was just lying in broad daylight to finish answering.
