Nero Company Limited CEO Anerlisa Muigai will have to pay her alleged ex boyfriend Ben Kangangi Kshs 2 million.
This is after the court found her guilty of defaming Kangangi through posts she shared on Facebook and Instagram about 4 years ago.
The ruling was made by High court judge Said Chitembwe, thus bringing the case to an end. The judge said that he was convinced by the evidence that was presented in court.
“The post directly referred to the plaintiff(Mr. Kangangi) and indicated that he was an unscrupulous businessman who conducted fraudulent businesses and could not be trusted. The plaintiff indicated that the claims by the defendant( Anerlisa) were false and the defendant did not provide anything to contradict the same,” the judge said.
“I am satisfied that in the absence of any contrary evidence, the plaintiff (Mr. Kangangi) was defamed as the evidence on record does prove that the plaintiff’s character was negatively affected.
“Given the evidence on record, I do find that a global award of Kshs. 2,000,000 shall be adequate compensation for the plaintiff. The plaintiff is hereby awarded Kshs .2million as general damages plus costs and interest,” Judge Chitembwe ruled.
Kangangi sued Anerlisa after she made a post about Kshs19.9 million that she had taken from a shylock back in 2015. The loan was to be repaid in a period of one week but that did not materialize.
Anerlisa who took to social media to tell her side of the story after she was exposed for owing the shylock millions said that she had borrowed the money on behalf of Kangangi, who was only her friend and not boyfriend as people thought. The two were rumored to have been in a relatioship for 5 years.
She claimed that Kangangi approached her to borrow the money for him because of her status promising to pay it within the stipulated time but he turned out to be a con artist.
“So in the second week of being given the money is when Dennis(the Shylock) started demanding for his money as I had promised to return the money within a week. Ben had promised the same. Right away I started calling Ben but his phone went unanswered, all I was being told is that he was taking numerous trips to Dubai,” part of Anerlisa’s lengthy post read.
In his lawsuit, Kangangi wanted a written apology from Anerlisa while requesting for permanent injunction and compensation for the damages he suffered due to the posts.
