Nandi senator Samson Cherargei was involved in an endless altercation with magistrate Mishemi Wendy at the Milimani Law Courts.
This was during the hearing of a case against him on Tuesday, where he is accused of making hateful remarks(hate speech).
According to a video clip of the court proceedings that was shared on social media, Cherargei continuously lectured the magistrate while giving her no room to address the matters at hand.
“Your honor, why are you rushing my status in the society? I am just like any other Kenyan and I should be treated equally not because of the status of the position I have just like your honor since morning, I have been raising serious issues and you have found it wise to ignore,” he claimed.
The magistrate tried to calm down the situation by asking Cherargei to respect the court but he continued raising his concerns.
” Your argument has been simple since this is an old matter. I thought it doesn’t affect whether justice is delivered whether today, yesterday or the day after. If the courts have to operate this way, it is like holding a gun to my head,” he said.
He also accused the magistrate of being influenced politically to frustrate him with the case.
“Why am I being intimidated? I thought courts are safe? They are even calling a police inspector! These are hostilities!” Cherargei further lamented.
The senator remained adamant that the case would not proceed without his lawyer, whom he claimed was handling another case in a different court.
He also questioned how the witness in the case against him would be questioned without the presence of an advocate.
The back and forth lasted for three hours and in the end, the magistrate directed DCI to probe the senator over contempt of court.
