DPP Clarifies Closing Pastor Ezekiel’s Case

Office of the Director of Public Prosecution (ODPP) on Tuesday, October 31 dismissed reports that Pastor Ezekiel’s case had been closed.

In a statement, ODPP denounced the claims indicating that the case was not under review.

However, ODPP vowed to make an informed decision after reviewing the files.

Here is the Breakdown of Pastor Ezekiel’s Case as Presented by ODPP.

Upon presentation of Odero, and on the application by the DPP, the court ordered that Odero be detained for seven (7) days pending investigations.

At the expiry of the seven (7) days, the DPP sought an extension of custodial orders for a further thirty (30) days to enable the police complete investigations, and more importantly to prevent potential interference of witnesses by Odero.

The court however admitted Mr. Odero to a bond of Ksh1.5 million with conditions not to interfere with witnesses and report to the investigators on a weekly basis.

Upon receipt of the inquiry files, the ODPP was satisfied that the court orders facilitating investigations had already served their purpose and it was needless for Odero to keep attending court or the police station.

Consequently, when the matter came up for mention today, 31st October 2023, the court CLOSED THE CUSTODIAL FILE.

The ODPP shall make a decision as regards to the results of the investigation as soon as the review thereof is complete.

The ODPP undertakes to continue exercising its mandate in accordance with the constitution and the law. To this end, the office shall ONLY make the decision to charge where the evidential and public interest thresholds have been met.
