City lawyer Donald Kipkorir has called out Lillian Nganga’s lawyer Philip Murgor for misadvising her in the suit against Machakos governor Alfred Mutua.
Lillian decided to institute legal action against Mutua accusing him of harassment and refusing to move on.
Mutua and Lillian both announced their breakup on August 15th 2021. On September 8th, the Machakos governor took Lillian’s car from her Kileleshwa apartment without consent.
“Mutua, accompanied by his police guard, Martin Nzinghi arrived at my apartment parking lot at Kileleshwa, Nairobi, and without my knowledge or consent and using a spare key which he had legally obtained, drove way my personal motor vehicle KBY 186G- a car which had been fully registered in my name since 2014,” read part of Lillian’s affidavit.
She also alleges her shares in Ndash Enterprises Ltd – the hotel company – were transferred without her consent. Ng’ang’a said she named the company after her high school nickname, Ndash.
“At no point did I execute a transfer of my shares or otherwise transfer my 1,800 shares (45%) shareholding in the company…” she said.
On September 22nd, Lillian requested Mutua for a mature and amicable separation before two mutual friends at Windsor Golf and Country Club.
However, Mutua refused to let go that easy and Lillian was forced to seek legal action against him. She filed a case at Milimani High Court on October 7th seeking a restraining order saying she believes her life and those around her were in danger.
In a press conference with her lawyer Philip Murgor on Thursday November 4th, Lillian said she was never married to Mutua, but rather they were long-term partners.
Lawyer Donald Kipkorir was quick to caution that Lillian’s lawyer misadvised her into making such an outrageous statement in full glare of cameras.
According to Kipkorir, Lillian’s admission that she was never married to Mutua is tantamount to her forfeiting all marital claims to property owned by the Machakos governor.
“By publicly admitting she is not married to Gov. Alfred Mutua, Former First Lady Lilian Ng’ang’a forfeits all marital claims to property of Mutua & opens herself up to fraudulent claims as First Lady of Machakos County…. Horrible legal advise,” Donald Kipkorir tweeted.

Korir added that;
“In Family Law, money & gifts given in contemplation of marriage are refundable in the event there is no marriage … The Former First Lady is obligated in law to refund the Governor. It is the law … Restitutio ad integrum.”
