Why Detectives Want To Detain Nick Mwendwa For 14 Days

Embattled FKF president Nick Mwendwa has been arraigned at the Milimani Law Courts following his arrest on Friday.

Mwendwa was arrested over claims of embezzling funds that were allocated to the body by the government.

He was arraigned before senior magistrate Wandia Nyamu but did not take a plea over fraud charges against him.

Detectives are now seeking to be allowed to detain Mwendwa for 14 days at the Gigiri police station as they conclude investigations on the matter.

“My co-investigator and I are investigating cases of fraudulent acquisition of public property contrary to section 45(1)(a) as read with section 48 of the Anti-Corruption and Economic crime Act, No. 3 of 2003 as well as failure to comply with any law or applicable procedures and guidelines relating to the procurement and Disposal contrary to section 45 (2)(b) read with section 48 of the Anti-Corruption and Economic Crime Act,No 3 of 2003 whicb the respondent (Mwendwa) is a suspect,” Chief Inspector Moses Mnangat said.

He said that they are yet to obtain relevant documents from FKF, various banks and record statements from various witnesses.

According to the Inspector, Mwendwa is likely to interfere with evidence if he is released on bail.

“Mwendwa will most likely destroy or conceal relevant evidence or otherwise interfere with witnesses and evidence collection thus compromising the investigations should he be released at the moment,” Mnangat said.

Mwendwa’s legal team comprises former Law Society of Kenya (LSK) chairman Eric Mutua and Makueni Senator Mutula Kilonzo Junior.

He was arrested when he had gone to pay a courtesy call to the Harambee stars team that had just arrived in the country after facing Uganda in a world cup qualifiers match.

The embattled FKF president spend the weekend behind bars with detectives questioning him how Kshs430 million allocated to FKF by the Sports, Arts and Social Development ministry for running football activities was spent.

He was also grilled on Kshs244 million extended to the federation to prepare Harambee Stars for the 2019 Africa Cup of Nations.

FIFA has however warned Kenya of a looming ban on international football activities if the FKF body is not reinstated.

FIFA secretary general wrote to CS Amina Mohamed calling for an urgent discussion over the matter so as to avoid further consequences.

“Going forward, without prejudice to the allegations that have been raised and any potential trial for offences that may have been committed, FIFA and CAF are asking you to consider the reinstatement of the FKF Executive Committee prior thereto,” part of the letter read.
