Former Nairobi governor Evans Kidero began the process of challenging Homa Bay governor Gladys Wanga’s victory in the August 9 general elections in court just days before she was sworn into office.
Wanga was sworn in on August 25 along 44 other governors, after beating Kidero in the Homabay gubernatorial race. She emerged victorious with 244,059 votes. Kidero, who vied on an independent ticket, garnered 152,182 votes.
In a letter addressed to IEBC, dated August 22, 2022,Kidero’s legal team requested to be provided with a number of things that were relevant in the general election with regards to Homabay county as they prepare for the petition.
“Arising from the above and by dint of yours being a commission established under article 88 of the constitution of Kenya and therefore bound by by article 2 of the constitution of Kenya, we hereby, under our client’s constitutional right to access information and under section 4 of the access of information ACT No. 31 of 2016 as well as under section 27(2) of the IEBC ACT No.9 2011 hereby request documents/and/or information with respect to Homabay county…” part of the letter read.
Information that Kidero wants from IEBC include; copies of forms 34, 35,36, 37, 38 and 39 A, B and C from all polling stations and Tallying centers in the county, Audit logs of what each Kiems Kit transmitted from polling stations to the tallying centers, IP addresses and GPRS location of each of the kits used in the general election.
Aside from that, Kidero also wants access to all SD cards used in the general elections, polling station allocation of the Kiems Kits, count of number of voters identified by each kit in the gubernatorial elections, count of voters identified alphanumerically and those identified manually.
Kidero further wants access to copies of manual registers used and poll diaries.
The former governor wants access to the above-mentioned information within 7 days, failure to which his lawyers might take a legal action.
