High court judge Theresia Matheka has declared that being a house wife is a full time job which should be payable.
While presiding over a matrimonial property dispute, Justice Matheka said that it is unfair for courts to rule that housewives do not contribute to the financial progress of the family.
The judge said that housewives should not claim that they don’t work yet they provide full-time services at home
According to Justice Matheka, it was unfair to only rely on visible income and the mindset that one has to contribute money to the marriage to find value.
“It is easy for the spouse working away from home and sending money to lay claim to the whole property purchased and developed with that money by the spouse staying at home and taking care of the children and the family. That spouse will be heard to say that the other one was not employed so they contributed nothing,” Justice Matheka said.
“Raising children is a full-time job that families pay a person to do. Cooking and cleaning as well. Hence, for a woman in employment who has to balance childbearing and rearing this contribution must be considered,” the Judge added.
She also said that the 9 months that a woman carries pregnancy should be considered by judges when presiding over such disputes.
According to the judge, carrying pregnancy is equal to working while noting that in the recent time, couples have been seeking services of surrogate mothers to bear children for them and pay them huge amounts of money.
Justice Matheka was presiding over a case where a woman who had separated from her husband was seeking to have the family property sold and the money shared equally between her and her ex-husband.
In her ruling, she directed that the property should be sold and the proceeds be split equally among the two or alternatively one party buy out the other party by paying half of the value of the property.
