A businessman has sought the removal of the Director of Public Prosecution (DPP) Noordin Haji from office over ‘favoritism’.
In a petition to remove the persecutor from office, Mr. Njeru alleged that Persecutor Noordin Haji has had a case of a certain property dispute involving him Mr. Njeru), China Road Bridge Corporation, and ARJ Capital. The property in question is located along Mombasa road, at Kyangombe village in Embakasi – and Njeru has claimed ownership over it.
The petitioner, Mr. Njeru, claimed that after investigations, the directors of ARJ Capital Ahmed Rashid Jibril and Farah Ali Mohamed were charged in January 2020 for conspiracy to defraud, making a false document, and obtaining registration of land by false pretenses.
However, after just less than three months, the DPP made an application that the case tying the two accused with a crime be withdrawn. The court, however, declined the application by Mr. Hajji – terming the case as having elaborate investigations, and that the matter ought to have been handled and determined with finality.
“The Petitioner has since established that the basis behind the Director of Public Prosecutions stubborn refusal to prosecute the suspects and his concerted efforts to have Criminal Case No 2144 of 2019 R v. Ahmed Rashid Jibril and Farrah Ali Mohamed withdrawn, is based upon his close family relations with the accused persons who are his first cousins and another a brother to one of Kenya’s influential Cabinet Secretaries,” the petition reads.
Njeru has also cited the Tecra Mungai murder inquest as one of the cases that the DPP has mismanaged the case where Mr. Hajji had also requested for the withdrawal of charges at the detriment of Omari Lali and recommended an inquest; the prosecutor would then command for an inquest into the case.
Noordin Haji has yet to make a rebuttal over the case seeking to remove him from the position.
