Acting Nairobi govern Ann Kananu Mwenda is set to assume leadership rolesĀ on Tuesday after she officially takes over the office.
Through a gazette notice, Ann Kananu will be sworn in on Tuesday at exactly 10 AM in the morning.
“PURSUANT to sections 14 and 16(1) (b) of the Assumption of theĀ Office of Governor Act, 2019, and in accordance with the provision of Article 74 of the Constitution of Kenya 2010, it is notified for information of the general public that the swearing in ceremony of Ms. Ann Kananu Mwenda, as the Governor of Nairobi City County, shall take place on Tuesday 16th November, 2021 at the Kenyatta International Convention Center COMESA Grounds, starting from 10.00 am.” Read the gazette notice.
The Supreme Court on Monday struck out an application by former Nairobi Governor Mike Sonko challenging the swearing-in of Ann Kananu as the next county chief.
Supreme Court judge Mohammed Ibrahim had on 25th October directed the Assumption of Office of the county and the committee spearheading the process to pause the swearing in of Ann Kananu to allow Sonko time to argue his case
The top court while throwing out the interim order which elapsed that Monday argued that it lacked the jurisdiction to entertain the former governorās application.
āWe lack jurisdiction to entertain the application. Objections by the clerk, Nairobi county assembly, and county assembly sustained. Motion dated October 23Ā is incompetent and hereby struck out,ā the court said.
According to the Star, Sonko moved to the Supreme Court after the Court of Appeal rejected his application to stop Kananuās swearing-in.
Appeal Court judges Wanjiru Karanja, Jamila Mohamed and Jessie Lessit dismissed his application on grounds that the issue of swearing-in Kananu was not raised in the High Court matter and the judgement delivered by that same court did not address or determine that issue.
āThe issue of swearing in Kananu was not a ground of appeal in Sonkoās draft. In that draft appeal, Sonko challenges the decision of the High Court which refused to overturn the impeachment process,ā they claimed.
