The court of appeal has acquitted 80-year old Rael Mayaka who had been convicted for gouging Baby Sagini’s eyes, his grandson.
Mayaka had been sentenced to 5 years in prison by a lower court but the jail sentence was quashed on Friday by Justice Kiarie Waweru after she appealed .
According to Justice Waweru, the prosecution failed to prove that Mayaka was responsible for gouging baby Sagini’s eyes.
The granny was convicted along two others. The two, Alex Ochogo(cousin) Pacifica Nyakerario (aunt) who were handed 10 years and 5 years imprisonment respective, did not appeal the court’s decision.
The trio are said to have committed the offence on 13th and 14th December, 2022 and were sentenced by magistrate Christine Ogweno for causing grievous harm to the minor.
