The first day of hearing the presidential election petitions is coming to an end. The day saw lawyers representing petitioners give their submissions before the Supreme Court judges while explaining why the election should be nullified.
Following the submissions, Justice William Ouko, who is among the 7 judges that are hearing the cases sought three clarifications from the legal team that is representing Raila Odinga, who is the first petitioner in the case. The first clarification was directed to James Orengo.
“I have three very short clarifications that I would like to seek from the team that is representing the first Petitioner. The first clarification perhaps I can direct it to SC James Orengo, what is the relevance of rejected votes when computing the results or the outcome of votes?” the Judge asked
The second clarification was addressed to Julie Soweto who addressed the issue of how postponement of elections in a particular area targeted the ODM leader.
“The postponement of elections in certain areas and you say this resulted in voter suppression. That people wake up to vote for a particular category of candidate. Do we have any scientific nexus on this or this is just an assumption,” Judge Ouko said.
Finally, the Justice sought to know the elements that should be met before the reliefs that the team was seeking under section 80 are granted.
Some of the reliefs that the legal team is seeking includes nullification of the elections, access to all IEBC servers which they have been granted, declaration of the winner of elections once the outcome from servers is established.
