Bad News For Alfred Mutua As He Is Blocked From Ditching Raila For Ruto

Date:

Alfred Mutua’s application to exit from Azimio la Umoja One Kenya Alliance has been rejected by the Political Parties Disputes Tribunal(PPDT).

This comes just a day after Mutua and his Maendeleo Chap Chap party severed ties with Azimio. The Machakos governor officially  moved to DP William Ruto’s camp, Kenya Kwanza citing unfairness, lack of transparency and inclusivity from Azimio side.

He moved to the tribunal to establish whether the agreement that Maendeleo Chap Chap signed with Azimio was binding.

The tribunal confirmed that the agreement was binding and stated that Mutua and his political party should have considered other ways of solving the disagreements within the coalition instead of exiting.

Mutua however argued that he only joined the coalition six months before the general elections and the binding clause blocking parties from leaving coalitions should not be applied to Maendeleo Chap Chap.

The tribunal however advised the party to resolve their disputes with Azimio even though they are now in Kenya Kwanza.

According to an advocate identified as Brenda Mdivo, Azimio agreement is  binding. She added that the governor was required to justify whether he was aware of that before signing it

“When you enter into a contract, the terms are decided by the party, it’s up to you to decide. For Azimio, they decided anyone cannot leave six months prior to the elections. For whatever reason, whether it was fully disclosed to the party or not they will have to justify it. In the case of Mutua, he claimed that the six-month rule was running when they signed,”
